Informational translation — the Romanian version prevails
This is an informational translation provided for convenience. The Romanian version of this document is the sole legally binding version. In case of any discrepancy between the Romanian and English versions, the Romanian version shall prevail.
This document is governed by Romanian law. Any disputes arising from or related to it are subject to the exclusive jurisdiction of the Romanian courts.
Terms and Conditions
These terms govern the relationship between you (Client — legal entity or individual) and Psihobusiness Consulting SRL, the company operating the JobGrade platform. They are written clearly, without hidden clauses, and apply to both B2B (companies) and B2C (individual users) use.

1.Definitions
- JobGrade: the SaaS platform provided by Psihobusiness Consulting SRL, VAT ID RO15790994
- Compania: Psihobusiness Consulting SRL — the legal entity operating the JobGrade platform and responsible for the services
- Client: poate fi:
- Client B2B — a legal entity (company, NGO, institution) using the services for its organisation
- Client B2C — an individual using the services for personal/professional development
- Utilizator B2B: an individual authorised by the B2B Client to access the account (HR Director, manager, facilitator, representative)
- Servicii B2B: job evaluation, salary structure, EU pay gap Directive 2023/970, recruitment, organisational development, HR document generation
- Servicii B2C: guidance in personal/professional development through specialised AI agents (thematic cards), personal HR Consultant
- Credite: unit of service consumption, purchased via subscription or additional packages
- Client Content: any data, documents, job descriptions, salaries, evaluations, conversations or journals uploaded or generated by the Client in the platform
- Pseudonim B2C: identifier generated by the platform to protect the B2C user's identity — AI agents do not have access to the real identity
2.Acceptarea termenilor
By creating an account and/or using the platform, the Client confirms that they have read, understood and accepted these terms, as well as the Privacy Policy and Politica de cookies.
The person creating the account on behalf of the Client declares under their own responsibility that they are authorised to legally bind the Client. For companies with collective statutory representation, it is the Client's responsibility to ensure the internal mandate.
3.Serviciile platformei
JobGrade offers, without limitation:
3.1. For companies (B2B)
- Evaluation and ranking of job positions across 6 criteria (internationally validated methodology)
- Salary structures by grades and steps (validated salary classification algorithm)
- Pay gap analysis compliant with EU Directive 2023/970
- Recruitment, hiring and induction (process + documents)
- Organisational development (culture, processes, multigenerational)
- AI assistance via HR Consultant for professional queries
3.2. For individuals (B2C)
- Guidance in personal and professional development through thematic cards
- Dialogue with specialised AI agents, under a pseudonym (real identity is not accessible to agents)
- Support in choosing a professional role, identifying aspirations and planning career progression
- Thematic communities with calibrated access (based on emotional readiness level)
- Anonymised recruitment bridge with partner companies (with user consent)
The list of active services may evolve. Significant changes are communicated at least 30 days in advance. The availability of a service for a Client may depend on the data provided (e.g. for B2B: job descriptions, organisational charts; for B2C: profile completion via Profiler) and on the credit balance.
4.Account & Authentication
- Account creation is free; use of services may require a subscription and/or credits
- For B2C, the account uses a pseudonim ales de utilizator — the real identity is not accessible to AI agents and is stored separately (privacy by design, two layers)
- For B2B, the account has an administrator (usually the HR Director) who can invite other users with specific roles
- The Client is responsible for the security of their credentials (password, active sessions)
- The Client must immediately notify the Company in the event of unauthorised use of the account (contact@jobgrade.ro)
- The Company may suspend the account in the event of a suspected security breach or non-payment
- B2C Clients may delete their account at any time from settings — 30-day grace period, then permanent deletion
5.Payments, Subscriptions & Credits
- Abonament: fixed monthly fee for platform access + included credit allowance
- Credite suplimentare: purchased on demand, with no expiry as long as the account is active
- Payment method: card (procesat de Stripe), conform termenilor lor PCI-DSS
- Facturare: automatic, monthly, by email with PDF
- TVA: applied in accordance with Romanian legislation (Psihobusiness Consulting SRL is a VAT-registered entity, VAT ID RO15790994)
- Refunds: see 5.1 (unused credits = refundable; executed services = non-refundable)
- Late payments: after 15 days, access to services may be suspended; after 60 days, the account may be closed
5.1. Refunds and Right of Withdrawal
- Credite neconsumate — refundable on a pro-rata basis (value of unused credits from the amount paid), upon request or upon termination, within 30 days, by means of the corresponding reversal of the fiscal document.
- Servicii executate complet (report generated and made available to the Client / analysis executed) — nerambursabile. Each credit consumed represents the complete and irreversible execution of a distinct service, not a subscription with continuous access.
- Consumator (B2C): the statutory right of withdrawal of 14 days (GEO 34/2014) applies to unexecuted services; it lapses for services fully executed with the consumer's prior express consent to the immediate commencement of the service (Art. 16 lit. a) and m) of GEO 34/2014), consent requested separately at the time of purchase.
- Profesionist (B2B): the non-refundability clause for fully executed services is expressly accepted by the Client at the time of purchase.
6.Client Obligations
- Providing accurate and up-to-date data (name, tax ID, address)
- Using the services for lawful purposes and in accordance with internal regulations
- Respecting the rights of their own employees (information, consultation, in accordance with the Labour Code)
- Ensuring a legal basis for uploading employee data (consent or legitimate interest)
- Not using the platform for illegal, discriminatory, or harmful activities
- Respecting the Company's intellectual property rights
7.Our Obligations
- Providing services with high availability (excluding planned maintenance announced in advance); specific SLAs may be negotiated separately in a dedicated contract
- Securizarea datelor conform Art. 32 GDPR (criptare, backup, control acces)
- Notification of security incidents within 72 hours (Art. 33 GDPR)
- Suport tehnic prin email contact@jobgrade.ro (response within business days)
- Prior notice (30 days) for significant changes to terms or prices
8.Use of artificial intelligence
JobGrade uses AI models (Claude by Anthropic) for evaluation assistance, content generation and advisory. Full details on the AI transparency.
- The AI proposes; final decisions belong to the Client
- No AI report or evaluation is used alone for decisions impacting employees without human validation (in accordance with Art. 22 GDPR and Art. 14 AI Act)
- The Company does not guarantee the absolute accuracy of AI results; the Client bears responsibility for validation
- Anthropic AI models are not trained using Client data (confirmed contractually)
9.Intellectual Property
- Platforma JobGrade (cod, design, metodologii proprii) — proprietatea Companiei
- Client content (job profiles, salaries, evaluations) — the Client's property
- Rapoartele generate are the property of the Client, but may be used by the Company in aggregated and anonymised form for service improvement and sector statistics
- Marca JobGrade is recorded; external use thereof requires written consent
10.Limitation of Liability
The Company is liable for direct damages caused by culpable non-fulfilment of its obligations, up to the amount paid by the Client in the 12 months preceding the occurrence of the event.
- The Company is not liable for indirect damages, reputational damages, lost profits or data losses caused by the Client
- Not liable for the consequences of incorrect use of the platform or AI results without human validation
- Not liable for unavailability caused by third-party providers or force majeure (the list of sub-processors is available in the Privacy Policy)
11.Termination
Either party may terminate the contract with written notice (email) 30 days in advance. Special circumstances:
- The Company may terminate immediately in the event of illegal use or non-payment > 60 days
- The Client may request the complete deletion of data (Art. 17 GDPR), in accordance with the Privacy Policy
- Financial data (invoicing) is retained for 10 years in accordance with the Tax Code
- Unused credits are refunded on a pro-rata basis within 30 days
12.Modificarea termenilor
The Company may update these terms. Significant changes are communicated at least 30 days in advance by email. Continued use of the platform after the effective date constitutes acceptance. Previous versions are archived upon request (contact@jobgrade.ro).
13.Dispute Resolution
The parties will attempt amicable resolution within 30 days. If mediation fails:
- Disputes are subject to the laws of Romania
- Jurisdiction: the court of first instance/tribunal at the Company's registered seat (Ilfov)
- For GDPR matters: ANSPDCP (www.dataprotection.ro)
- For employment matters: territorial ITM

This document constitutes a civil contract between the parties. For matters not explicitly covered, Romanian Civil Code, Tax Code, Labour Code and European legislation (GDPR, AI Act, Directive 2023/970) apply.
